Towing and storage rates for non-consensual tows (those ordered by law enforcement) may be subject to California state and local rate regulations. If your vehicle is in our storage facility, daily storage fees accrue from the time your vehicle arrives. You are responsible for all accrued fees at the time of release. Vehicles not claimed within the period specified by California law may be subject to lien sale in accordance with applicable regulations.
You agree to provide accurate information about your vehicle, its location, and the nature of the service needed when you contact us. Providing false or incomplete information that results in our sending the wrong equipment or crew may result in additional charges.
You are responsible for removing personal belongings from your vehicle before it is towed or stored. Benicia Towing Service is not responsible for personal property left inside a vehicle in our custody, except as required by applicable law.
Benicia Towing Service will take reasonable care in handling your vehicle. However, our liability for any damage to your vehicle or property arising from our services is limited to the actual documented cost of repair, not to exceed the fair market value of the vehicle at the time of the incident.
We are not liable for any indirect, incidental, or consequential damages arising from our services or from your use of our website, including but not limited to lost income, missed appointments, or delays in delivery schedules. Some states do not allow the exclusion of certain damages, so these limitations may not apply to you in full.
